Legal in both states does not mean legal between the states. You cannot legally bring cannabis into Maryland from another state, even if you purchased it legally and are old enough to possess cannabis under Maryland law. Cannabis remains prohibited under federal law, and transporting it across state lines is illegal. Maryland’s legalization of adult-use cannabis applies to possession and use within the state under specified conditions; it does not authorize interstate transportation of cannabis.
Why Can’t You Bring Cannabis Into Maryland if It Is Legal Here?
The issue is the state line.
Maryland permits adults age 21 and older to possess specified personal-use amounts of cannabis. Current Maryland law allows qualifying adults to possess up to:
- 1.5 ounces of cannabis flower
- 12 grams of concentrated cannabis
- 750 milligrams of THC (edible gummies, chocolates, beverages, tinctures).
Those possession rules do not authorize interstate transportation.
Crossing from another state into Maryland implicates federal law because cannabis remains federally regulated. The Maryland Cannabis Administration specifically warns consumers that entering or leaving Maryland with cannabis products remains illegal.
That is true even when cannabis is legal on both sides of the border.
What if You Bought the Cannabis Legally in Another State?
A legal purchase does not change the interstate rule.
Suppose a Maryland resident legally buys cannabis while visiting another state that permits adult-use sales. The fact that the dispensary was licensed and the purchase complied with that state’s laws does not authorize the buyer to drive the product back into Maryland.
Once the cannabis crosses the state boundary, the situation is no longer simply about lawful possession within either state.
Does a Medical Cannabis Card Let You Cross State Lines?
No. Medical cannabis patients are subject to the same interstate restriction. Maryland’s Cannabis Administration states that a legal patient may travel with medical cannabis within Maryland, except on federal property, but taking cannabis across state lines remains prohibited.
Maryland also does not extend its medical cannabis purchasing program to patients merely because they hold a medical cannabis card from another state. An out-of-state adult who is at least 21 may purchase cannabis through Maryland’s adult-use market, but an out-of-state medical card does not authorize interstate transport.
Can You Drive With Cannabis Within Maryland?
Generally, adults who are legally permitted to possess cannabis can transport a lawful amount within Maryland, but other restrictions still apply.
You cannot smoke or consume cannabis while driving. Maryland law also prohibits a driver from smoking or consuming cannabis in the passenger area of a motor vehicle on a highway.
Driving while impaired by cannabis remains illegal as well.
That means lawful possession does not eliminate potential traffic or criminal consequences when cannabis is consumed in a vehicle or affects someone’s ability to drive safely.
What if You Accidentally Cross the Maryland Border With Cannabis?
Crossing the border unintentionally does not change the fact that cannabis was transported across state lines, but the circumstances can still matter in determining what legal consequences may follow.
Where the cannabis came from, how much was present, where it was located, and what police allege occurred can all become relevant.
Maryland also has separate criminal statutes addressing bringing particularly large quantities of controlled substances into the state. For cannabis, those provisions can carry serious felony penalties when the statutory quantity thresholds are met.
A personal-use situation and an allegation involving large-scale transportation therefore raise very different legal issues.
What Should You Do if Police Find Cannabis After You Cross Into Maryland?
Do not assume that because you legally purchased the cannabis, there cannot be a legal problem.
Avoid making unnecessary statements about where you purchased it, where you were traveling, or what you intended to do with it. If police conduct a vehicle search, the legality and scope of that search may also become relevant to any resulting case.
Keep any citation or charging paperwork you receive and avoid discussing the incident publicly while the matter is pending.
Legal Cannabis Stops at the Maryland State Line
Maryland’s cannabis laws allow adults to possess and purchase cannabis under defined circumstances, but those protections do not extend across state borders. Buying cannabis legally somewhere else does not make transporting it into Maryland legal.
