What Constitutes Assault in Maryland?
Under Maryland Criminal Law § 3-201, assault is broadly defined and includes both the threat of harm and actual physical contact. Maryland law does not distinguish “assault” and “battery” separately like some states do; instead, both are treated under the general umbrella of “assault.”
There are two main categories of criminal assault charges:
Second-Degree Assault
- The most commonly charged form of assault in Maryland.
- Involves intentional or attempted offensive physical contact, or the threat thereof.
